Legal Question in Criminal Law in India

498A queries

I am Hindu girl married hindu boy in 2006 under HMA in India. After marriage my in-lwas were not happy with me.So they used to provoke me and my husband for divorce.Initially my husband used to treat me nice but they brainwashed him and even he started me treating very badly. My mother-in-law through her brother threatened my relatives of dire consiquences if i will not give him divorce.Recently i lodged 498a against my inlaws.

Few months back some one had hacked my email and sent few emails(exchange between me and my ex boy friend before marriage) to my relatives by post to malign me.I have not been in touch with him after marriage.I am sure this was done by my inlaws to malign me.

1)Can i approach the police to take fingerprints from the copy of emails sent to my relatives to establish the fact that this was done by my inlaws?

2) will it help my 498a case,if i can estlablish this was done by my inlaws?

Yes, this may be covered within the definition of "Cruelty" under Section 498-A of IPC as well as under D.V.A.

You may consider making a complaint to the local police for hacking of your email account, for unauthorized printing/distribution of your private mails.

The act mentioned by you is a criminal office under cyber law of India.

Before that what had you mentioned in your complaint registered against your in-laws and you did not mention about whether you had also mentioned your husband as co-accused also.

Secondly are do you want to continue your martial relationship with your husband or you want divorce and lead a cool and straight life.

With regarding to your e-mail transaction you can certainly file a complaint with local police as per cyber law act and seek action against the culprits for their wrong doing.

Fingerprints from hard copy of email appear difficult. Even if fingerprints can are available, same would lead you no where, unless you are able to establish that those emails are written and sent by your in-laws by hacking your email.

What action Do you want to take that is not going to give you any help because the matter is not as such that who hacked your ID and sent the copies of e-mails to your in-laws the matter is that you had some communication with your EX-boy friend therefore you will not be succeeded to draw the sympathy of the court on this sole ground.as far the help is concerned In my view this will go in your disfavour. but your in-laws also cannot take this ground for divorce because this act doesnot comes under Adultery.
