Legal Question in Criminal Law in India

498a query

I have lodged 498a against my husband and in-laws two months ago.As of now no progress has taken place.The Police is neither calling my in-laws and husband nor telling us anything clearly.They live in another state.Can we sent a written complain to the SP or we need to visit SP in person?Can STATE WOMEN COMMISSION help us in this matter?Plz suggest me is there any other place where i can approach?

Approach in person to SP. If SP is not able to assist you then approach a competent court for the same. I beleive to do all the above you should appoint a local lawyer.

(1) You may send a written complaint to the SP.

(2) If a personal visit to SP office is present, you may seek a meeting with the SP and explain him your case;

(3) The State Women Commission may also be approached simultaneously as an additional measure;

You may also approach the High Court of your State for appropriate directions to the police u/s 482 Cr. P. C.

It may be better to engage a local lawyer who may be dealing with the local police on regular basis. If you may seek support of your local police, that may be more helpful instead of any confrontation.

If police is not investigating an offence registered with them, then first one need to approach the superior police like S.P. and thereafter the High Court.

Yes you can approach SP with copy to CP thru written complaint.
