Legal Question in Criminal Law in India

I have one criminal case before Additional Chief Municipal Magistrate Court in Bangalore. But till date the proceedings have not started. Meanwhile, can i make an appeal to quash the charges against me in which the police have made base less charges against me. Please tell me how and under what rules i have provisions to make appeal before the same court or higher courts.

u can move under 482 crpc but i will advice to go after filing of charge sheet. and file it only when you are having speaking proofs of your innocence. consult a good lawyer before moving to high court. dont take it lightly as if the complaint was not quashed then it may harm you.

I agree with Mr. Gupta. But it is High court alone which has the jurisdiction to quash the proceedings.
