declaring a person as proclaimed offender

the lower issued NBW against a NRI who is involved in a criminal case.but he is not coming to india to face the trail/ court proceedings. NBW is pending since 2 years.when he approached the high court for anticipatory bail, high court dismissed his petition, but ordered him to surrender before the trail court in 30 days.but he did not come to india to surrender in lower court. still he is living in USA. in this situvation, can the lower court declare him a proclaimed offender?

He can be declared as a PO and the order may be supplied to the concerned US authorities for his arrest and deporting to India.
