To Fight against False 498A

Ours was a love marriage. She forced me to marraige as early as possible causing my careeer hampered only to hide her secret gyenological disease. She was carrying huge tumours in both her uterous and overies, and they were in serious condition. She had an early opeartion much before our introduction, and pretending to love me only to manage her operation as she lived with her uncles, and her parents got mutual seperation.

so she found it convenient to victimize me only. we got our registered marriage, and then by social marriage.

On the very first day of my conjugal life, I found her crying for bleeding through her vagina and navel as the tumours were so big they bleed often. I got shocked to see all these. so our marriage didnt get consumated, having no sexual contact ever and ever. I started seeing her doctor, the doctor did immediate opetation for amputation of all her overies, uterous, falopine tube. They infected in huge manner. I was threatened by her not to disclose about her treatment, so she dit shelter in her uncles home for opetation. and never come back since then for the last 5 years. Now she had filed a false 498A, and maintenance (125 Crpc). What should we do( we got bail from lower court of our jrsdcn.

As regards case u/s.498A, if reading the case papers, no case is made out, then you can consider filing for quashing. Else, you need to proceed with trial.

As regards matter u/s.125, you need to pay her reasonable maintenance determined by the Court.
