Legal Question in Criminal Law in India

Hi,

I was working with an firm for 2 months. Due to some circumstances i have to resign from the company. even though i have not sent any resignation mail from to my company but we mutualy agreed for that.

Now they have my 2 months salary with them which they are not releasing. they provided me a cheque of one month salary which got bounced.

Recently i visited the office for settlement but Boss told me that he has no funds, but on the very same day he released salary of employees.

Please suggest me what can i do, and by any chance i'll be getting my complete salary for 2 months or not.

also if i file a case against them can i ask for some compensation against mental harrasement also.

IMP:- the cheque was against my one month salary, not for two months. but also i have recorded all my conversation i had with my boss

Issue notice for cheque dishonour and also one month of salary as well. Then file a criminal complaint through lawyer.

yes, you may file a complaint u/s 138 of Negotiable Instruments Act and also a suit for recovery u/o 37 of CPC.
