Legal Question in Criminal Law in India

my husband had filed a case against me in cyber crime in kolkata. in his FIR he states i being his wife had hacked it for immoral gains. i have been in my parents house in delhi ever since i have been thrown out from by his mother from kolkata. can he file a case in kolkata as if suppose the crime has been committed it is from delhi.

What crime was committed in Delhi? Jurisdiction in cyber laws are different then the criminal laws . There must have been reason for your husband to file the FIR in Kolkatta and accepted by the cyber cell of kolkatta.

in case the crime was committed in delhi and the f.i.r is lodged in Kol, you may file a transfer petition (criminal) in the hon'ble Supreme Court of India and get the case transferred to Delhi.
