Legal Question in Criminal Law in India

I am an Indian- Victim of Cr PC 498a (Dowry law)

My wife has filed a false dowry case on me in Feb 2007 under IPC section--name removed--Due to this sudden blow, me and my parents were jailed for 4 days. How can I prove my innocence in the court as in India at this time even the court believes the women and do not go into details, but if given a chance I can prove my innocence as all my neighbours, friends know that I had taken a good care of her always. She has also files maintenance case and some Hindu act 9 case from her town for which I have to go to court every month. Please suggest what to do now?

You have no option but to counter/contest the cases filed by your wife.You can get the case transfered to your town.You have to counter the cases filed by your wife with strategy.detais of facts are required to suggest the measures.Contact with details

Unfortunatley law does not provide adequate remedy for poor husband, but to go in court and contest and meet with the allegations made by his wife. So you also do the same, and if you prove your innocence, then file suit for defamation, torts, compensation etc.

The primary duty would be on the police and your wife to prove your guilt. An accused in not required to prove his innocence, but is presumed to be an innocent until proved guilty.

no short cuts possible. You need services of a good lawyer.You will have to face complete trial.Yes you will have to pay maintenance if she is not employed. Since you have asked for suggestion about what you should do. my sincier advise is that if possible compromise the dispute with her and save yourself and your parents of the harrasment. I will like to clear the misconception that courts believes woman. It may appear to be so but not in reality. It is the system of justice which is to blamed. The law is same for all. The petition u/s. 9 HMA shows that she want to join you.

contest the case in the said court and file affidavits of the persons known to you that u are innocent, that may make some impact. take some crowd with u in the court.
