Legal Question in Criminal Law in India

private complaint

Someone told me that if police doesn't register a criminal case, we can get that registered through court as a private complaint. For registering a private complaint is there any time limit from the date of occurence of the crime?

Re: private complaint

You have been rightly informed. The time limit depends upon the offence and it shall be for the court to decide. Your statement is incomplete and vague as you have not mentioned the problem or the offence involved.

You may lodge your complaint with the court of your area. the court may ask you to produce evidence (preliminary evidence) before summoning the other party; or else the court may send your complaint to the police u/s 156 (3) of CR. P.C. for registration of a case and investigation. In that situation the police may register the complaint and report investigation result to the court;

Re: private complaint

It's not private complaint. You need to lodge a complaint case in the court. I do not understand why Police will not take your case. If at all Police is not taking a F.I.R. write to the SP of your district and send by registered post giving your complete contact details. [email protected] Mobile : 09334217032

Re: private complaint

Yes, of course, you may lodge Private Complaint if police does not register FIR. Upon complaint, court may examine the complainant and summon the accused. Private Complaint can be lodged under section 200 of the Code of Criminal Procedure.
