Legal Question in Criminal Law in India

Respected sir this is a very imortant query kindly give attention, I have purchased a mobile phone for a sum of Rs. 33000. When I got technical faults in said phone company did not repair said handset and he replaced handset with a new one( same model 1st replcement ), again after 2 months I faced technical failure in said handset then again company changed phone with a new ONE ( same model 2nd rep.) ... then again after one day I got technical failure in said handset then again company changed handset WITH A new one (same model3rd rep. )

Now again after 4 months I have faced technical failure in said handset then company is saying that we are replacing your faulty phone with a new one ( ready to give 4the replacement )... but this Time I am not agree with the replacement because of previous replacements did not give me relief....

Now I am saying to company that replace this faulty phone with another model phone I am ready to pay difference amount for another of company...

Am I right or wrong ?

Status - Company official saying this is not possible to replace phone with another model but after my request said official said to me that I will discuss the matter from seniors but I am not giving you commitment for replacement of faulty phone with a new one another model... I WILL TELL U TOMMOROW REGARDING THIS

If company not replace my faulty phone with a new one another model what is the legal remedy is left for me ?

I am also a student of law but I did not have sufficient knowledge of consumer law

Dear Sir / Madam,

It is important that you make "the right choice to avoid later noise." When it comes to mobile phones, brand name plays a vital role. It is always advisable to pay a bit more, but settle for the best brand names like Nokia or Ericcson, which are time tested and have the best after sales service.

Going in for other lesser brands of repute, means risking yourself to manufacturing defects, and poor after sales service as in your case.

You may request the Company to service your mobile free of cost, in case they disagree to replace your handset again, having already replaced your entire handset once. It may also be that your usage is rough, leading to the need for repair.
