Legal Question in Family Law in India

498A-bail-chargesheet

All our family members are under bail due to false 498A. In my bail condition, it says A1 has to appear before the police station on every 15th of month until charge sheet is filed. Charge sheet is not yet filed. bail was sanctioned on may second week. Today only i came to know about this condition. Even my lawyer didn't inform me about this. But I am regularily attending for the court adjournments.

1. though i am attending before the court regularily, is it mandatory to attend before police station also as per bail?.

2.How to make it as regular bail?.

3. If i attend before the police station, is it mandatory to appear before the court also?.

please suggest what should i do.

Re: 498A-bail-chargesheet

if you are attending the courts, am sure you are not attending the court where you case u/s 498a is supposed to be pending. no court can call you unless charge sheet is filed. you surely have violated the condition of bail and you must visit the police station on 15th of every month in compliance with the bail order otherwise the same would be cancelled. you must be attending the court where your divorce petition or other petition is pending and that does not mean that you appeared before the local SHO. you may call upon me at 9811284735, delhi for further clarifications.

Re: 498A-bail-chargesheet

You have to comply the court order. You all will be released on regular bail from the court only if the police present your case in the court. For further query contact me

Re: 498A-bail-chargesheet

You have to comply with the condition stipulated in bail order,so you have to appear before Police station and also before concerned court.Your lawyer must have to tell you this condition. It seems that bail has been granted to you with condition. After filing of the challan you may apply for regular bail from the trial court where the challan has been filed. For any other assistance you may contact me personally.

Re: 498A-bail-chargesheet

you and your advocate should have been vigilant.

it is mandatory to follow whatever has been said by the order of the anticipatory bail. so u need to appear at both places

go to the police station now and tell them that you were not aware of that condition and that you will appear now onwards.

for further and detailed advice please contact in person. Consultation charges will apply.
