Legal Question in Family Law in India

My cases are filed against mother inlaw and husband.Husband is abroad.Cases are -498A and DV Act.Although my parents are working,my ddad is retiring next year with no pension.And mother will retire in the next 2 years.I am not working myself.

My questions are:

If I hire a private lawyer,how will his fees be decided on the basis of my family's financial status as explained above?

How do we know that the lawyer is genuine?What if he joins hands with the opposite party & extorts lot of money from us?

We have no contacts in the judiciary.So I'm going to an NGO whose services are pathetic and the lawyer here is not hard working.Please advise.I'm suffering for 3 years now due to husband's desertion,mental cruelty by him and mother inlaw,all belongings with them,etc.My cases are in Delhi's Patiala House court.

At times it becomes a very "uneven" fight. You have to gather strength and try to understand your legal rights. It may be better to fight your case "in person" without engaging a lawyer. The law is in your favour and courts are inclined to help victims of 'cruelty' and / or 'domestic violence'. You may seek help from your parents for pursuing your remedies.

If your husband/in-laws approach you for a compromise, you should consider mutual settlement even if the terms may not very favourable for you.

no one can guarantee you that your lawyer would be honest or not. its all our karmas and some day or the other, we pay for it, whether we lawyer or not.

in your case, as your case is being handled in a pathetic manner, you have no other option but to hire a lawyer of your choice. as far as fee is concerned, that varies from lawyer to lawyer. most of the lawyers remain loyal to their clients in case the clients pay up the fee on time. dont lose heart, you will get your dues and your lawyer as well.
