Custody of 2 Yr Old Child
My husband n me have regular fights 'n he hits me in front of my 2 yr old daughter,he even tried to force himself on me even when he knows the fact that I hate him the most in the world.I want to file for a divorse and we are living in the U.A.E. Both me and my daughter r on his visa n he is threating that he would take the baby away from me.What chances do I have of getting custody of the child.I am a working mother and have a maid to look after the child.I need to have custody of the child without whom I cannot think of living.Please advice and help.I am sick and tired of living with my husband because of his nature and immaturity.Friends are more important to him than family.

You can apply for divorce and custody of your child in the local court where you were married.

you can file for divorce generally custody of small child is given to mother you can claim maintiance for the child

You are entitled to custody of your child.
You can also file a crminal case against your husband under domestic violence act as also under the Indian Penal Code for hitting you.

You will get the custody of the child thats preety sure and claim maintenance as well. You may file an criminal complaint against your husband under Domestic Violence.

Till the age of 8 years you have the right to have the custody of your child.

First of all you can file a criminal complaint in the local Police Station against your husband, If you feel threatened. If you have resources my advice (without prejudice) is to live seperately.
