yes, in case he is able to prove that the mother of the child is unable to take good care of the child and he can take a better care.

I do not agree with the above opinion.
Yes he is entitled to custody of a child even below five years. He does not have to prove that she is unable to take of the child or that he will take a better care. However, the courts may not go into the "rights" of the parties but decide the custody issue keeping into mind the "welfare of the child".
