Criminal case has already been registered and they are behind the bar. You can always appear in person or through advocate and oppose his bail application etc. Keep facts ready with you and post them where ever he seeks relief. Have some advocate from Free legal aid or paid advocate to oppose his release from jail. Restitution of conjugal rights is never done in such type of case. File maintenance proceedings and ask for custody of child on the basis of criminal record of the father.
