Legal Question in Family Law in India

Re. : ipc -498a, ipc-125c, ipc-323, ipc 406

If there are false charges against nri (non residence of indian). How does thi charges affect to the person who is not living in india and having other countries citizenship ? What he/she should do to protect. Does she need to fight in india. Or just stay in own country. If he/she does not take any action and judgment will be taken against him/her. How it will effect or impose on him/her. How does maintance cost recover in india if person is in overseas.

You must through your autherised person or attorney duly attested from the competent autherity, contest the criminal matters in the concerned court to defend yourself and to prove the same false. You must procure the copies of the complaints to know the facts with date,day and year of the occurance so that you rebut the same. In case if you were not in India than by filing photo copies of passport, you may inform the court that the cases are false as you are away and out of India when the allegations wre made agaist you. After getting the court finding you may file suit for damages and criminal prosecution for filing the falses cases. Further if you will not contest than than the order will effect you.

Maintenance cost may recover from your property if any stands in you name in India otherwise not.

she/he can stay outside india but the status of the case is not clear from the above description.

i would suggest you to contact some lawyer to check to status of the case and advice you accordingly.
