Legal Question in Family Law in India
I am legally divorced since 3 months. I have a daughter, 11 years, who stays with me. My ex-husband is a lawyer by profession, an alcoholic and does not pay maitainance that was granted to me and my daughter. I am willing to forego the maitainance money, but want custody of my daughter legally as I am planning to remarry, apply for passport for me / daughter & correct school records of my daughter. My daughter does not even want to see her father ever as he had always tortured her. Please advice me as to what I should do to get legal custody. Looking forward to your valuable advice.

You may file a case for EXECLUSIVE custody of your daughter. Since the child is already, the court may ascertain her wish also before taking a final decision.
