Legal Question in Family Law in India

I got married in India in aug 2008. I live in North America. I filed for a divorce on the grounds of cruelty in India. My husband and family is asking for 15 lakhs INR stating that that's how much money he spent to take care of me during our marital life. Please let me know if there is any grounds upon which he can demand this money from me in order to get a divorce. Also he has not provided that much money for me in our marital life.

NO NO and a BIG NO. you dont have to pay even a single penny to your husband and his family members. There is no Law which says that. Rather you should ask them to pay you for maintenance.

It is a surprise to me to know that a husband is claiming money from his wife for Divorce. You are not going to give in to there demands and inform them that you are contemplating to file a complaint for dowry demand etc before Crime against women cell and book the entire family of the husband in a criminal matter.I am sure this would send right signals to your husband and his family.

there is a provision u/s 24 of Hindu Marriage Act under which a husband may also claim maintenance from wife in case the wife is well placed in life and husband unable to maintain himself. however, a lawyer has to go through the petition as well as he application filed by the husband in order to give a well considered opinion.

he can demand maintnance, if he is not employed, from you, if you are employed, but he can not calim amount in liue of looking after you after your marriage. If your husband is well placed and you are not earning anything, you have right to claim maintenace and residence from your husband. matrimonial laws are pro-women and have proper measures to safeguards your intrest.
