Legal Question in Family Law in India

I am married since last five years, I have a four yrs child from her, due to clashes she went to her parents home since 1 yr and currently she is staying there with their parents...I want to apply legal separation from her and take the child's custody...So am I eligible to do that legaly ? if yes how should I go about and file application for the same in court...

Normally custody of child is not granted to father as long as child is below 5 years. You have also not stated whether child is male or female. Court would also consider wishes of child, which you may bear in mind.

You will be granted right to visit the child.
