in a matrimonial case the petitioner in an appeal against divorce granted by trial court wants to take advantage of restoration of case after likely dismissal in default and hence not showing up on the dates in order to delay the case.please advise if the court can be requested to hear arguments ex parte on merit or any other advise from you as deemed fit

in case he is being represented by a lawyer, he need not present himself. ex parte is granted when neither the party nor the lawyer appears.
