Restitution of Conjugal Rights

Dear Sir,

I want to take my wife back in my house. She will level many allegations like torture and desertion against me and will try to prove it. Please explain how I can get the degree passed in my favour. What methods should be adopted to defeat my wife in this case. How much is the period of this case to be going on.

If you have a desire to bring her back to matrimonial home, do it with full force of your conviction. do not anticipate a negative behaviour from her; possibly your love and care; and the pain of past desertion will change her attitude. law does not provide any remedy for anticipated fears. as on date u have no cause of concern and u do not need any legal advice. Friend, what is the point in bringing your wife back, if you have no love and affection for her. Why do you want to defeat her ? Marriage is all about bringing a win-win situation to both of you. If your sole purpose is to defeat your wife, then restitution of conjugal rights is not a remedy.

You should rather think of divorce. any judge after reading your intentions is going to sympathise with your wife. You have a wrong notion towards wife and marriage. This is not a battle. If you want to win over your wife, let her win in court. You will purchase peace and happiness.

Sorry, with a question like yours, an Advocate like me would rather go with the wife's case than yours.

send a notice for restitution of conjugal rights alleging desertion, mental torture etc and then file a case for restitution for conjugal rights

you may file petition for restitution of conjugal rights to bring back you wife alleging that she had withdrawn from matrimonial society without any cause and excuse and in case if your wife will allege the allegation like torture & desertion than you will get an oppertunity to rebut. you can also file case for RESTITUTION Of conjugal right to bring back your wife. there is no time limit for case proceeding for getting the decree of finality of case.you have to rebut the allegation of your wife.Take advise from a lawyer.
