Legal Question in Family Law in India

schizophrenic wife

I have been married since 6 months and I have come to know that my father-in-law and my wife both have paranoid schizophrenia. The father-in-law interferes in day-to-day activities making our life miserrable.

My wife is 5 months pregnant with our baby. What are an husband rights, with respect to divorce and child custody, when he comes to know after marriage that his wife is schizophrenic??

Will the marriage stand null and void on grounds that it was not mentioned to us before marriage and this fact was conceled from us??

Re: schizophrenic wife

Yes, you may consider filing a petition for nullity of marriage; It may be better if you engage a local Advocate to pursue your remedy.

Re: schizophrenic wife

everything would depend upon the symptoms that you have not mentioned. in case the same is curable, it will not be considered a ground for divorce and in case it is incurable, you may seek divorce on this ground alone along with child custody.

Re: schizophrenic wife

Yes,probably your ground is not to be taken easily. You can file a petition in the court about your father in law if any worse happened with his deeds in the tranquility and peaceful living of your family.About your divorce it is not advisable to you to file divorce petition as its only 6 months since you are married.
