I last stayed with my husband in 24th August 2011, should we file a mutual consent divorce after 24th August 2012? How many time is needed between filing mutual consent divorce petition and appearing in the court for the 1st motion ?

If both of you have decided to call it quits then you can file your mutual consent petition after august 24th 2012 . If you file your 1st motion petition august 25th ,2012 ,it will list before the court next day ie. august 26th ,2012. So relax.

yes, you can file divorce by mutual consent after staying separate form your husband for one year. after filing first motion for divorce by mutual consent, you both need to wait for six months for filing a second motion. after second motion is allowed, the decree for divorce would be passed.

you can file divorce petition and may be you will get divorce within few days or a weak depends upon your circumstances and location.
