Can a wife claim right to alternate residence or residence under DV act if she is earning HRA as a part of her salary. THe said case is due for interim arguments. Moreover her educational qualifications are MPhil, MCOm and BEd and earning a total in hand salary of 31000 per month including HRA. IS their a judgement or order in support of this.

The wife cannot claim residence order from the court in her favour in her case as mentioned by you.

in case the husband is earning much more than the wife and there is a substantial gap between their earnings, she may claim alternate residence and other benefits.
