Legal Question in Family Law in India

Wife's name change

Hi,

I am getting married in few days, and my wife would like to change her name. As per Hindu tradition, wife's surname automatically changes after marriage, but I would like to know how do we get her name and surname both changed?

Is it advisable to change her name before marriage itself? Or do we wait till marriage and then apply for name change?

Any help in this regard is greatly appreciated.

Thanks in Advance,

Ganesh

Re: Wife's name change

The name Changing has to be done after the Registration of marriage, or after the Hindu marriage,

An affidavit has to be done showing the existing name and daughter of ____ then you have to show the changed name alongwith the husband's name, but if you are proceeding abroad, you have to change in the passport also, you have to get it corrected in her passport and also in your passport.

You have to advertise in the local newspaper stating that she has changed her name and give ten days time after which it will be accepted.

the Above procedure are done to change the name.

Re: Wife's name change

Dear Sir,

This is with reference to your query dated August 26, 2003.

We understand that your fiance wishes to change her name. In order to change her name, she has to follow the following procedures:

1.Declaration in an affidavit duly attested by the concerned Sub Divisional Magistrate,

2.Publication of the change of name in the newspaper.

It does not create a difference whether the name is changed before marriage or after marriage, practical problems apart.

In case you require any clarification, please feel free to contact us.

Thanking you,

Yours truly,
