Blocking of Roads in Residential colony

In the Residential colony that I stay in, people have blocked the roads thereby blocking my access to the park thru the road.

kindly advice me what are the laws against this kind of encroachment. Can I go to Consumer Court for this.

filr a writ petition in the high court aginst the muncipality u cant go the consumer court

You have a right to file a suit seeking directions against the planning authority to remove the encroachment or you can file a Writ of Mandamus before the jurisdictional High Court.

In your matter, Consumer Forums do not have jurisdiction. Remedy will be to approach a Civil Court. If the Road blocked is a public road, then you may considering approaching the local authority for removal of encroachment.

Answer:

Residents in a colony have the same rights as that of the people living outside it; when the Roads are blocked by the people you are denied of your right to move about; You are a citizen having fundamental rights and duties. When your rights are curtailed you should see it restored; you could complain the matter to the civil authorities there; blocking a public road is a Criminal offence, and therefore you can approach the Police also, but not a consumer Forum
