Legal Question in Civil Litigation in India

Dear Sir,

My aunty is widow and also the owner of a JCB (Vehicle used for digging, planing in construction work) and my uncle had died last year , due to some problem my aunty had gave the JCB to her Lawer and now the lawer is in the posseion of the vehicle and want Rs.50000 and this lawer also helps during the Accidental case in which my uncle had died. Kindly help me in this regard, what should i have to do although all the papers in my aunty hand.

Kindly help me in this regard.

in case there is no hypothecation agreement between your aunt and her lawyer, she can repossess the JCB.

(a) She should send a notice of demand to the lawyer;

(b) In case the demand is not met, a complaint against the lawyer may be made before the Bar Council of the State concerned.

(c) A complaint against the lawyer may also be made with the local police.
