We have to get father's gratuity money after his death. but succession certificate is mandatory for same. Our stepmother does not live with us so please tell me how can we get succession certificate and is it mandatory to present stepmother in front of court. Can we get succession certificate excluding stepmother. we are two brother and three sister one sister is mentally retarded.

yes, you need to present your step mother also in the court by sending her summons or asking her to appear and give NOC in your favour if she wants. even mentally retarded sister and other siblings need to be summoned.
