private road

A private mutual road agreement by 23 persons is not registered original kept a person. Now he does not want to agree to leave road but he walk on others land who left for road. I have BDA approve plan. He construct boundary on the road which has approve road bY BDA to my house. At present I access other lane walking over safety tank. this mutual lane road not approve by BDA or it will never approved by BDA due to very narrow. BDA need at least 12 ft road for approved Building permission for ground floor & first floor. This road I will not get building permission.

What type of legal action can I take?

Is there any judgement this similar case?
