Legal Question in Civil Litigation in India

i have purchased a flat in kharghar navi mumbai thr a agent.i hv done 95% of payment & hv all receipts but now the owner is absconding & he has given power of attorny to his wife & daughter. & they are not ready to give possession & complete the remaining procedures(final sale deed).agreement is already done.i hv filed a complaint in consumer court & it is under process. can the consumer court now deny the case as it is a civil matter.i dont want to go for civil case as it is time consuming. but if no other option can i go for civil, criminal case & cosumer court at same time? pls help

you should have file case under Specific Relief Act in civil court simultenously with consumer court complaint.
