Legal Question in Civil Litigation in India
A suit for declaration was filed against us in a city civil court in the year 2006. We filed our reply. Now the plaintiff has filed his affidavit of evidence. However, the court has no pecuniary jurisdiction to try the said suit as it is valued for over 80 lacs. Will the suit come to be dismissed on the ground of jurisdiction? Please advice

the suit can be returned for refiling in the appropriate court of law.
