Legal Question in Immigration Law in India

Student visa For Sister of US citizen

I am US citizen and presently studying in Georgia Institute of Technology,Atlanta. My parents had been in US 20 years back for around 8 years. However they returned back to india and decided to stay there. They surrendered their

greencard and now have visa for US to visit both their children who had been born here and therefore are US citizens.

However my sister is non-US citizen. She on her merits got admission to Univeristy of Washington,Milwaukee. She plans to stay with parents back in India once she finishes her graduation. However I and my brother, both US

citizens fear that she wont be able to get visa for US due to the fact that we are US citizens.

It is very painful thinking that we are the one to stop her education just because we were born in US. We both want to know, what is the best she and my parents can do so that she gets her rightful education.

Filing a petition for my sister will result in waste of few precious years in her life when she is not intenting to stay over in US.

Your help and suggestion will be highly appreciated,

Since your sister has been accepted in the Univ. of Wisconsin...she should apply for student visa.

I'm an Advocate in India and I'm not licensed to practice in U.S nor am I competent to give advice on American Law. It is considered illegal by American legal system. I think this question should be addressed to an American Attorney at Law actually. However I will suggest that you can go to www.ins.gov and find out from there the answer to this question. In the event that you are unable to find out please get back to me and I will try to assist you. I think that website answers the question that you had raised.

and other related links. I think you need to spend some time on the net to get this information and help your sister and nothing more is required on my part.

She should apply for a student visa. Your own residency status should not affect your sister's eligibility for a student visa. She should contact both the university and the INS for the appropriate forms.

Your question isn't really that clear but from what I can gather, if you simply want your sister to have a U.S. education, then let her apply for a student visa. Simple. It should really be no problem, especially if parents can get tourist visas to visit you regularly and she already got admitted to the school.
