Legal Question in Insurance Law in India

LIC Policy Issue

My father had purchased LIC plan

namely 'Varishtha Pension BIMA Yojna' worth rs 266665/- monthly pension 2000/-. There is a clause of minimum requirement of attainment of 55 yrs age should be there. My father was not having any Birth Certificate/ SSC Marksheet for age proof so he submitted affidavit for age declaration.

Unfortunately he passed away and in death certificate issued from municipality has mentioned age less than one year than the age calculated on the basis of Affidavit.

The reason for difference is due to in Ration Card by mistake from my father age mentioned was less than 1 year than original and I have submitted xerox of Ration card to municipality for death certificate issuance and they have issued and calculated age on the basis of Ration card endorsement.

I have a doubt in processing of death claim by LIC will this death certificate creates any trouble for claim processing or I would require some other sets of document ready.

Note: I have original copy of Affidavit declaration and in the policy papers age admitted field is marked as 'Y'

I do not see any hurdle to claim insurance amount. However,it is better that you get the age corrected in govt. records. The policy details and other details are required to be examined.consult a local lawyer with all details.

Death certificate is document made subsequent to the affidavit and the D.C could be modified based on the said affidavit before appropriate authority. Inadvertant errors are rectifiable and said error sufficiently explained should not be hinderance in your claim.
