Legal Question in Employment Law in India

Compensation regarding termination.

hello,

my question is this...a person is working for the past 25 yrs. in a private firm and his record has been exemplary, but now probably due to some reason the new location head does not want his services and the compensation package is also paltry...i want to know what are the legal remedies available and what compensation package should he receive.

thank you,

Re: Compensation regarding termination.

What kind of work was the person doing? was it managerial or clerical? If it is non-managerial, or non-supervisory, then, he is entitled to statutory benefits. Otherwise, the benefits will depend on terms of employment. Hence, better details are necessary.

Re: Compensation regarding termination.

This is really very vague. Do you have a personal problem or is this a theoritical question? If this is a theoritical question, I will not answer this as a matter of policy. If on the other hand, this is a personal problem, you need to provide at a minimum the cadre in which You were working and the emoulments drawn and whether the termination was due to bad conduct and disciplinary proceedings or is it voluntary but negotiated retirement. The question is so vague that it is difficult to answer. Without disclosing your identity (None is shown as a matter of fact by www.lawguru.com) you can furnish the details to get an accurate picuture. Otherwise please treat your query as rejected for insufficient data and appearing to be a theoritical question.
