harresment by employer

I am working in limited company in india. I resigned on 29th jan 2008 but before this I had my two month salary on hold there due to low performance. Now I am asking them to clear my dues but they are refusing as some payments were of my client were not clear now they had cleared the payment. Branch manager is saying that you had resigned before collecting your full payment it was deducted from your salary Please help me out.

One more thing that I had qualified for an incentive of 30,000 also in Nov. sale but they had stopped it at branch level.

Send them legal notice for clearing your dues. However, the same shall be subject to the contact between you and your employeer. If you had resigned without following the due procedure, and if there is any such term in the contract allowing employeer to make deduction then you cannot do anything.

And so far so as incentive is concerned, you are still entitled to get your incentives, that you had accrued during your employement. However the same shall be subject to the provision in the incentive scheme itself.

You may recover your dues by way of recovery suit.
