I have joined a private limited comopany on 8th September 2011 as Assistant Manager-Finance.

I have left the company on 13th January 2012 by giving notice dated 27th December 2011. During the tenure of employment, i was in probation period.

The letter of resignation is acknwoledged by the Management of the company saying i will be releaved on 13th of Jan 2012 and accordingly i got releaved on 13th January 2012 vide relieving letter dated 20th jan 2012.

While doing full and final settlement, referring to terms and conditions of appointment letter, management is asking for refund of salary of 44 days for releaving early i.e in 17 days against notice period of 61 days without option for surrender of leave and salary in lieu of.

Management has even not considered my entitelment of variable pay while computing full and final settlement.

Please suggest what should be my next step.

In particular i want to ask, if management is so particular about notice period of 61 days, why did they releaved and given letter to that effect. Even a step further they have clearly written in resignation letter the date of releaving.

U can send legal notice and can file complaint in labour court.
