Legal Question in Employment Law in India

Relieving letter required

I had resigned from Axis Bank last year in Aug. As i got a job in PNB it was not possible for me to serve a complete notice period of 30 days.

At the time of my resignation i inquired about waiver of mandatory notice period & they told me that if a person is going for a govt job or abroad it is not mandatory to serve the notice period provided Branch Head will recommend for the same.

So i served a notice period of 24days & requested for a waiver of 7days. My Branch Head has also recommended for a waiver of notice period & my salary was also deducted for this reason. They have also done my PF settlement.

But now after 10 month of follow up they have declined my request for relieving letter stating that i have joined competitor bank so they will not issue relieving letter

Is there any way i can ask for my relieving letter?

Hi,

tjere is no way they can do this... They have deducted your salary also. So no point holding your releiving letter... serve them with the legal notice, you will surely receive your releiving letter.

you may approach a lawyer and he would serve a legal notice in this regard and if need be a suit for mandatory injunction may be filed.
