Legal Question in Employment Law in India

I am working in private organisation under probation period for 6 months. Now I am in 3rd month and gave resignation due to health problem. But the organisation asking me to pay one month salary or I month prior notice before resigning the job. I am not willing to pay. Shall I give notice and can avail medical leave by the providing from the medical certificate. Because I should be in bed rest at least for 2 Months. After getting cured I plan to run my own business. please suggest as soon as possible.

If the terms of your appointment require you to give the Company one month's notice after resignation or one month's salary in lieu thereof, you will have to abide accordingly.
