I have a three bed room flat in Chennai that I have rented out for last three years. Though I am getting the rent promptly, I feel I should have proper legal hold so that I can evict him in case he creates a problem in future. The tenant is a business man and the agreed rent is Rs.23000 per month.

1. What precautions should I take to ensure that I can evict him in case he creates a problem in future?

2. In the lease agreement what should be the period of tenancy?

3. What is the value of stamp paper to be used for the agreement?

5. Can you please suggest a good advocate in Mugappair/Anna Nagar area who is good in tenant law so that I can have personal discussions?

Your best bet is to enter into a written lease agreement incorporating all the terms including the term of period, rent, enhancement, purpose and more important the penalty clause. And, do get the lease agreement registered.

2. In the lease agreement what should be the period of tenancy?

If lease agreement is registered, normally, the period depends upon mutual convenience and your requirements.

3. What is the value of stamp paper to be used for the agreement?

Refer to any local lawyer
