Rent case in chandigarh

I am tenant in chandigarh.The landlord has claimed rs.4000/- as monthly rent,since 01-06-2002.I tendered total rent arrears,alongwith cost and interest in the court on the basis of provisional rent assessed by the rent controller at the rate of rs.1000/-p.M. On the basis of solitary reny rent receipt dt. 04-11-02 issued by the previous deceased landlord.The rent controller has fixed issues:

a. For the plaintiff/landlord to prove----non payment of rent,personal necessity,nuisance

b. For the respondent/tenant to prove----counter claim of excess rent paid,including bills of repairs, unclean hand of landlord,non-maintainbility of the petiton u/s 13 of east punjab rent restriction act,1949. It is pertinent to mention that the petition filed by the landlord is false and frivolous in the garb of senior citizen and highly frivolous.Secondly,the landlord has sufficeint accomodation in this one canal house,including one house at mohali.The landlord is alone in the whole house and i being a tenant has possession of only two room on the ground floor.Thirdly,regarding nuisance,the whole family members of the landlord has been booked by chandigarh police u/s 107/150 cr.P.C.Next date for evidence by landlord is 31-05-2007.Guide me how to win

as far as rent case is concerned it is not possible for us to comment on winning and loosing the case without going through the papers.

if you can prove the facts you have mentioned then you may win the case.

as far as the case of 107/150 crpc is concerned its a petty matter and i dont think that it will have any impact on the case of rent.
