Legal Question in Landlord & Tenant Law in India

I have been residing in a rented flat since 1953, (from my age of 5) when my father was the Tenant, since 1974, the landlord made me tenant of at the same premises. I am 62 years old at present.

The original landlord Mr. Khan expired in 1961. His eldest son collected rent till 2001. After his death another brother started collecting rent. This brother had Power of Attorney to collect rent & do all commercial deals. We got the Building repaired through MHADA in 2003-04.

This landlord brought his youngest brother (Who resides in Middle East) in 2008 to our building & said that he will collect rent. No power of Attorney was shown to us. In 2009 this brother was supposed to visit us to collect rent which he never collected. I have been paying rent by cheque all the time so I sent rent cheque for entire year to the elder brother who gave me rent receipt in Feb 2010 and the cheque was deposited by him in his account in March2010.

Meanwhile under pretext of need for their own premises Landlord took possession of 2 flats fro tenants by paying then much less sum that the market rate for surrender of tenancy.

Landlord did not collect rent for 2010 but I sent rent in June2010 to his brother, Cheque was cleared in August 2010 but till date landlord did not give me rent receipt.

I have today sent cheque by Registered Post for year 2011.

Please let me know if there is any way I can pay rent in Court so that my tenancy right is not forfeited because of landlord�s tactics.

you can approach court and court will allow you to deposit rent over there.
