as advised earlier, selling branded clothes without express consent of the brand manufacturer, is illegal. the manufacturer appoints distributors etc so that his stuff is sold through proper channel.

Export surplus is sold in the market by the exporter(s) because the buyers have rejected these clothes for there own showrooms etc. Exporters are left with no choice but . to sellin the open market. There is no illegality in the entire transaction.

There is no wrong in selling branded cloths. No need for consent of brand manufacturer. one can always buy and sell things in open market.

Just one thing, under EXCISE Law, for export oriented units, there is sometime excise exemption. So if the goods are for export and they have taken excise exemption, then they cannot be sold in open market, unless excise is paid. For this only one caution, buy it under a legal bill from whom so ever you are buying.
