Legal Question in Personal Injury in India

my aunt was to receive compensation before 10 years under m.v.act.my uncle died in an road accident.but due to certain circumstances she was not able to withdraw.now when we approach to old lawyer he told us that the amount was withdrawn.even court record show the same.can we proceed against the lawyer? he said that the respondent was not able to compensate full amount.can we proceed against respondent?

You have not stated why your aunt could not withdraw. If it is so, then your lawyer cannot withdraw it without your aunt's signature. You verify the records and then give a complaint.

If the facts stated in your query are true, it apparently becomes evident that the compensation amount awarded to your aunt was fraudulently withdrawn. It is well within your legal right to take your advocate / lawyer to task to ascertain where the truth lies.
