Legal Question in Personal Injury in India

Defamation

I am serving as a Dy. Project Manager in a foreign based company which deals in road construction in India. Recently one local newspaper has published an article which against me saying that I am corrupt, which has tarred my image in my company as well as in society. I want to sue the editor of the paper.

What shall my lawyer do in such a case? Pls. advice in some detail.

Re: Defamation

If the imputations published against you are defamatory in nature you can prosecute the concerned editor/s, reporter/s, printer/s and publisher/s. In addition you can also file a suit for damages against them. Noramally, such an action is preceded by a Notice, though such a Notice is not mandatory. However, advantage of sending a Notice is that you generally know the defences of proposed Accused and/or Defendant in advance.
