Kidney failure due to Accident

The person met with a road accident(his scooter collided with a Lorry) four years back and sustained mutiple fractures in both limbs(femur bones)

he underwent major surgeries like interlocking nailing for both femur bones. More than two lakhs Rupees had been spent.

The patient had got infection in his fractured bones whic is still continuing(chronic osteomyelitis).

one year back it was discovered that the person had bilateral renal parenchymal disease( kidney Failure).

The patient has to undergo ''dialysis'' twice a week so as to continue his survival.

The patient could not go for kidney transplant because of his chronic osteomyelitis. Transplant cannot be done untill the bone infection is totally cured.

Insurance case(United India Insurance Co.)has not been finalised.

- can he claim for more amount from the same insurance Co. for dialysis and kidney transplanting charges?

- are there any such previous cases where accident victims suffered from kidney failure and courts holding the insurance company related to road accident liable for the kidney failure also? If so what are the cases?

How much amount can be claimed?
