malicious prosecution

i have filed a suit for mali prse against elect board for rs 25 lakhs this is in lieu of criminal case won by me i have paid acourt fee of rs 1000 and will pay the balance after the court determines the damages is it possible kindly help with some sc citations.

I would recommend you to pay the court fees as your suit can get dismissed as it has got nothing to do with judgement of the case winnig of loosing anything at all.

Yes,but you have to firstly pay the court fee on your amount claimed.payment of court fee has nothing to do with your winning or loosing of your case, as it is being paid at the time of filing of case.

Winning or loosing has nothing to do with the payment of court fees. Once you bring the suit inthe court, then you will have to pay necessary amount of court fees. Otherwise there are possibility of even the suit being getting dismissed on account of non-payment of court fees.
