motor vehicle accident

dear sir, i met with a fatal car accident on 1st feb 2005. a speeding lorry collided with my car(i was the driver) on the national highway and i suffered grevious injuries. i was in coma for 10days and still now iam suffering the pains. but till date i have not filed a case on the opposite party. can i file the case now?and does any lawyer over this web site deals with such kinds of cases on sharing basis? expecting an early reply

You can file the case even now. There is no limitation for filling a case for compensastion. The second question no lawyer would like to answer since sharing the outcome of some proceedings will amount to misconduct on the part of lawyer.

Yes, you can still file case of compensation. As such there is no conception of case on sharing basis which is otherwise a misconduct.However, in case of need you may contact.Professional charges are applicable.

The limitation regarding filing the compensation case has been removed from the Motor Vehicles Act. But while filing the FIR you need to expalin the delay in filing the FIR after so much of gap. In the FIR you have to mention the complete circumstances of the case along with the number of vehicle and name of driver & owner (If available) of the offending vehicle.
