Legal Question in Personal Injury in India

Sir,

My father got an accident 9 year before. As per the judgement 165000/- will be given soon, and remaining amount 350000/- will be given after 5 yrs(as Fixed deposit).To give better treatment our house and land sold after accident.

Now we are looking for a house.It would be very helpful if the amount 350000/- get it now. What should I do to get the amount?

I have to give the fee to advocate, what is the normal percentage given to the advocate for a MACT claim.

Dear Prasanth,

The quantum of compensation in an accident is based on the extent of physical disability.

You should ascertain the exact date specified in the judgement for receipt of Rs. 1,65,000/- (Rupees One Lakhs Sixty-Five Thousand Only) and ensure you receive the proceeds from the Company into your father's bank A/c, since Rs. 3,50,000/- (Rupees Three Lakhs Fifty Thousand Only) is in the form of a Fixed Deposit receipt.

Senior advocates in Mumbai charge a one-time representation fee of Rs. 1,000/-. I do not foresee any reason why your advocate in Kottayari, Trikoditanam should charge you more.

Please pay the advocate after the work is done.
