Legal Question in Personal Injury in

One of my Trustee is going from house to house of my church member and spreading false allegations against me and my character. There is no base whatsoever, and he claims it to have happened over 5 years back, and the person against whom I have misbehaved according to him is dead three years back. Can I file a defamation suit against him?

yes, you may file civil as well as a criminal action for defamation. Only thing you have to keep it mind that you will have to incorporate the negative impact of such defamation in your goodwill and reputation. If there is no negative impact in your reputation by such false allegation defamation is not complete. this is very important ingredient which normally is not paid attention to.

yes, you can file a civil suit for slanderous remarks but criminal may not be maintainable as the slanderous remarks require proof and civil, you may have to prove by leading evidence and in case you file the criminal case as well, the dismissal of the same may affect ur civil action.
