Legal Question in Real Estate Law in India

we 3 brothers and 2 sisters are owners of movable and imovable properties in kolkata, west bengal. the house is occupied by tenants also. due to shortage of space i shifted to another place and our elder brother eldest of all is planning to shift to his new flat now. due to various disagreements the eldest of all i.e. our elder brother wants to file a partition suit demanding equal share of properties. whereas the other 4 legal owners does not want partition suit. my question is will the hon'ble court of law agree to his claim and force 4 of us to accept partition. if i do not accept his lawyer's letter then what will be the outcome?

any of u can ask for partition before the competent court of law and the court will give him/her his part of the property. after procuring the decree to that effect he can further ask for possession on his share in the property.
